The National Union of Disabled Persons of Uganda (NUDIPU) using its position on the JLOS working group lodged an inquiry into the status of persons with mental disabilities awaiting criminal trial before Court. The inquiry was later followed with the judgements in Bushoborozi Eric vs Uganda and CEHURD & Iga Daniel vs the Attorney General which highlighted gaps in the law that needed addressing by way of law reform and reform in practice. These judgments found the provisions for indefinite pre-trial committal of persons with mental disabilities to be unconstitutional.
On Thursday 7th July, 2016 Disability Rights stakeholders led by NUDIPU had a meeting with the Chief Justice of Uganda, Chief Justice Bart Katureebe at which a memorandum on "Inclusion of persons with mental illness in access to justice" was presnted. At the meeting the Chief Justice tasked NUDIPU and its partners to come up with a Zero-draft of possible court rules to guide judicial officers on the handling of PWDs before court.
NETPIL and the coalition partners have, since 2017, been implementing a project ‘Promote Access to Justice for Persons with Disabilities’ The project is working towards improved access to justice for persons with disabilities (PWDs) through initiating and ensuring the adoption of The Judicature (Cases of Persons with disability) Rules.
The project is implemented under a coalition of three organisations the Network of Public Interest Lawyers (NETPIL), National Union of Disabled Persons of Uganda (NUDIPU) and East Africa Centre for Disability Law and Policy (CDLP). The Coalition is working in partnership with the Uganda Human Rights Commission (UHRC) and the Judiciary.
